These Terms of Service ("Terms") govern your use of the Salwa mobile application ("Salwa," "the App," or "the Service") operated by Quan Ho, doing business as Salwa ("we," "us," or "our"). By downloading, installing, or using Salwa, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

Salwa is a reflection practice app for iOS. It guides users through a three-step practice: write a brief reflection about something they are carrying, sit with it during a 90-second breathing session, then make a deliberate choice to release the reflection or hold it. Released reflections are permanently deleted. Salwa is designed to help users build a daily practice of emotional awareness and release.

2. Eligibility

You must be at least 13 years of age to use Salwa. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13 in compliance with COPPA.

3. Account and Authentication

Salwa supports sign-in through Apple Sign-In and Google Sign-In. When you create an account, you are responsible for maintaining the security of your authentication credentials. We do not store your Apple or Google password. Your account is linked to the unique identifier provided by these authentication services.

Use of the Service after any introductory offer (such as a free trial) requires an active Salwa subscription, purchased through the App Store and tied to your Apple ID. A subscription and sign-in are also used to sync your data across devices where that feature is available. There is no separate unpaid “free tier” of the App after your trial period ends, except as may be required by law.

4. Salwa subscription

Salwa is offered only as a paid subscription. There is no free tier. We offer the same feature set in two billing options:

Salwa AnnualUSD $59.99 per year, with a 14-day free trial that provides full access to the Service. Billed as one payment per year.

The App may also offer guided breathing exercises (including belly, box, and deep breathing), emotion tagging on reflections, a 90-second sit-with-it session, Your Practice (including emotion trends, consistency, and release history), optional daily reminders, light and dark (or system) display themes, and an experience with no ads, as these features are updated from time to time in the App.

Auto-Renewal Disclosure. Subscription automatically renews unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account at confirmation of purchase. You can manage or cancel your subscription in your device's Account Settings at any time after purchase. If you cancel during a free trial period, you will not be charged.

Pricing may change from time to time. We will notify existing subscribers before any material price increase takes effect where required, and you will have the option to cancel before the new price applies.

5. Free trial

Eligible users may start either Salwa plan with a 14-day free trial that provides full access to the Service during the trial. Eligibility, including whether you have used a free trial or introductory offer before, is determined by Apple. If you do not cancel before the free trial ends, your subscription will automatically become a paid subscription at the plan rate (Monthly or Annual) you selected, unless you cancel in accordance with Apple’s process.

If you have previously subscribed to Salwa, Apple may not offer you another free trial. Refer to the App Store and your Apple account settings for the terms that apply to you.

6. Your Content

"Your Content" refers to the reflections, emotion tags, anchored moments, and any other text or data you enter into Salwa. You retain full ownership of Your Content. We do not claim any intellectual property rights over what you write.

When you choose to release a reflection, the reflection text is permanently deleted from our servers. This is by design. Released reflections cannot be recovered.

We grant you a limited right to use the Service to store and process Your Content solely for your personal, non-commercial use. You grant us a limited license to store, transmit, and display Your Content to you through the Service, solely to provide the functionality of the App.

7. Privacy and Data Handling

Your privacy matters to us. Our Privacy Policy describes in detail what data we collect, how we use it, and your rights regarding that data. By using Salwa, you also agree to our Privacy Policy.

In summary, Salwa uses Supabase for secure data storage, Firebase and Crashlytics for analytics and crash reporting, and Apple/Google authentication services for sign-in. We do not sell your personal data or Your Content to third parties.

8. Data Deletion

You may request deletion of your account and all associated data at any time by contacting us at hello@salwaspace.com. Upon receiving a verified deletion request, we will permanently remove your account data, reflections, anchors, and practice history from our servers within 30 days. Some anonymized, aggregated data that cannot be used to identify you may be retained for analytics purposes.

9. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to: attempting to gain unauthorized access to our systems or other users' data, using the Service to distribute harmful or illegal content, reverse-engineering or decompiling the App, or using automated tools to scrape or extract data from the Service.

10. Intellectual Property

All rights, title, and interest in the Salwa app (including its design, code, animations, breathing exercise patterns, and all other original elements) are owned by Quan Ho. The Salwa name and logo are our trademarks. You may not use them without our prior written permission.

11. Not a Medical or Mental Health Service

Salwa is a reflection and emotional awareness tool designed for personal use. It is not a medical device, a licensed therapy service, or a substitute for professional mental health treatment, psychotherapy, counselling, or medical advice. Nothing in the App constitutes a clinical assessment, diagnosis, or treatment recommendation.

If you are experiencing a mental health crisis, thoughts of self-harm, or any medical emergency, please stop using the App and contact a qualified mental health professional, call your local emergency services, or reach the 988 Suicide & Crisis Lifeline (call or text 988 in the United States).

By using Salwa you acknowledge that the App is a self-directed wellness tool and that we are not responsible for any outcome resulting from its use or non-use.

12. Disclaimer of Warranties

Salwa is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Quan Ho shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of Salwa, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Quan Ho and its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

15. Third-Party Services

Salwa integrates with third-party services including Apple (Sign-In, StoreKit, App Store), Google (Sign-In, Firebase, Crashlytics), and Supabase (data storage and authentication). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.

16. Termination

You may stop using Salwa at any time by deleting the App from your device and, if desired, requesting account deletion. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, with notice where practicable.

Upon termination, your right to use the Service ceases immediately. Sections 6 (Your Content, regarding ownership), 11 (Not a Medical or Mental Health Service), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), 14 (Indemnification), and 19 (Governing Law) survive termination.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Your continued use of Salwa after the effective date of revised Terms constitutes your acceptance of them.

18. Refund Policy

All subscription payments are processed exclusively by Apple through the App Store. We do not handle payment transactions directly and cannot issue refunds ourselves. If you believe you are entitled to a refund, you must submit a refund request directly to Apple at reportaproblem.apple.com or through your Apple ID account settings. Refund decisions are made by Apple in accordance with their policies.

If you cancel during a free trial period before it ends, you will not be charged. Cancelling your subscription after a billing period has begun does not entitle you to a refund for that period; you will retain access to the Service until the end of the paid period.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Massachusetts.

20. Dispute Resolution

If you have a dispute with us, please contact us first at hello@salwaspace.com. We will make a good-faith effort to resolve the issue informally within 30 days of receiving your written notice describing the nature of the dispute and the relief you seek. If informal resolution fails, either party may pursue their claims in the courts described in Section 19 (Governing Law).

To the fullest extent permitted by law, any claim arising out of or related to these Terms or the Service must be filed within one (1) year after the claim arose. Claims filed after this period are permanently barred.

21. Feedback and Suggestions

If you submit ideas, suggestions, feedback, or feature requests about the Service ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and incorporate that Feedback into our products and services without restriction or compensation to you. We are under no obligation to act on any Feedback you provide.

22. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms caused by circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, cyberattacks, or failures of third-party services such as Apple, Google, or Supabase.

23. General Provisions

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. A waiver of any breach of these Terms will not be deemed a waiver of any subsequent breach.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quan Ho regarding the Service and supersede all prior or contemporaneous agreements, representations, or understandings.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any successor-in-interest to our business, including in connection with a merger, acquisition, or sale of assets, without notice to you.
